Greek Law 1733/1987 on Technology Transfer, Inventions, and Technological Innovation protect inventions (the Greek Patent Law). Through an administrative process conducted before the OBI, a patent is granted. The OBI gives the inventor an absolute (unrestricted and unrestrained) and exclusive right to own and utilize a particular patent.
Filing requirements
To obtain a date of filing, the patent application in Greece must contain at least the following:
- Application form;
- Description of the invention;
- Claims on a separate sheet of paper;
- Proof of payment of the filing fees.
Novelty grace period
Under Greek law, grace periods are recognized in specific cases. Patents could be granted for inventions that have been disclosed no earlier than six months preceding the filing of the patent application if the disclosure was due to:
- An evident abuse of the rights of the applicant or its legal predecessor; or
- The invention being displayed at an officially recognized international exhibition. In such cases, the applicant should state that the invention was displayed on the application and submit the relevant supporting certificate.
Validity term
A patent is valid for 20 years, beginning on the day after day the patent application was filed. When a priority claim is based on an overseas filing, the validity period is measured from the day after the filing in Greece. Following submitting an application for a Supplementary Protection Certificate, the protection term for pharmaceutical and plant protection goods may be extended by up to five more years (SPC).
