Chile has an open economic policy to entice and promote the presence of the greatest number of investors. This has allowed Chile to pique the interest of those eager to set up shop in Latin American countries. This is why being able to register the trademark of such commerce is a necessary component of forming a corporation.
You can maintain security and stop others from stealing the name, utilizing it, and making money by registering your company’s trademark and avoiding the same or similar trademarks.
Trademark registration procedure
First, you must determine if the trademark is registrable, which means that it cannot cause confusion or deceit or be similar to other trademarks that have already been registered or applied for.
The application must be submitted at the INAPI office or online after evaluating the trademark.
INAPI Office: The government department in charge of managing industrial property is INAPI, or Instituto Nacional de Propiedad Industrial. The form must be turned in to the INAPI office in typed handwriting. You must complete Form N° 10 regarding Tax Revenue and make a one-time payment in the single tax account. This payment must be made at a bank or other tax-collection facility.
Online: On the other hand, you must sign in to the INAPI site and submit the application form to complete the process online. The first cost for this method must be paid via an electronic transfer. It’s crucial to note that you must use your special password to register a trademark. You must fill out an electronic form when you first access this site.
Classifying your trademark following the WIPO’s International Nice Classification is one of the registration’s most crucial steps since it affects the application’s value.
Finally, you must contact INAPI for more research after submitting the application.
Within 20 working days of the application’s approval, the applicant must seek and pay for the trademark application’s publication in the Official Gazette. Third parties have 30 working days following the publication to object to the registration application.
Period to Oppose:
The opposition period is 30 working days from the application’s publication date.
Requirements for the Power of Attorney:
The original Power of Attorney must be submitted. It may be provided later, within 60 days of applying for Chile’s trademark registration.
Priority document: The original Priority Document translated into Spanish must be submitted to the Chilean trademark office within 90 days of the filing date.
