Trademark Registration Process

Applications for trademark registration in Ireland are processed through the Irish Patents Office.

Once the application is submitted:

  • It is examined by a trademark attorney to ensure compliance with legal requirements.
  • National and European databases are searched to ensure there aren’t any pending or registered trademarks similar to or identical to the target mark. If so, registration can be rejected.
  • Once the trademark attorney is confident that the proposed trademark can be registered, objections and oppositions are requested, and the trademark is published in the Official Journal of the Patents Office.
  • A Registration Certificate is given if no such opposition or objection is filed within 3 months.
  • The trademark must be renewed after the certificate of registration’s 10-year validity period.

Period to Oppose

The application will go through a thorough (formal and substantive) evaluation, including looking for similar marks and assessing its distinctiveness. Any interested party may object to the trademark application in Ireland within three months of publication.

Validity Period

Grant fees must be paid within two months of the Controller’s request for payment. A registered trademark in Ireland has a ten-year initial validity period that is renewed an unlimited number of times for additional ten-year periods. An application for renewal must be submitted during the grace period of six months following the expiration date or not earlier than six months before the expiration date. A surcharge is applied if the application is submitted during the grace period.

Requirement of Use

If a trademark in Ireland has not been used continuously for five years following the registration date, it may be liable for cancellation.
