Trademark Registration in Poland

The Polish Patent Office in Poland provides trademark protection. Community trademarks registered at the Office for Harmonization in the Internal Market (OHIM) in Alicante are recognized and protected in Poland due to Poland’s participation in the European Union. You can register internationally with the International Bureau of the World Intellectual Property Organization in Geneva (WIPO).

In Poland, a trademark may be protected either by national laws or by the legislation of other countries.

Trademark Registration Process

To obtain the filing date, a trademark application in Poland must contain the following:

  • request to register a trademark containing information about the applicant;
  • filing fee;
  • representations of the trademark;
  • an indication of goods and services the trademark will be used for.

A formal examination, a distinctiveness examination, and a search for previous trademarks are all included in the application procedure. The entire process takes about two years, from initial filing to registration. The trademark is published in the monthly “Wiadomosci Urzedu Patentowego” following registration. Only after the registration has been authorized can an opposition be submitted. The opposition period lasted six months after the registration was published in the “Wiadomosci Urzedu Patentowego.”

Period to Oppose

The term for filing an opposition against a Polish trademark is three months from publication.

Validity Period

Three months after the judgment was issued granting the right of protection, there is a deadline for paying the legal grant fee for a trademark certificate in Poland. A trademark in Poland is valid for ten years following the submission of the application to the Polish Patent Office. Polish trademarks are renewable indefinitely for periods of 10 years. Before the registration period’s termination, 12 months in advance, renewal fees must be paid. You can renew within six months after the renewal deadline by paying an additional cost.

Requirement of Use

The validity of a trademark in Poland may be revoked in case it has not been used within five years from trademark registration.
