The Trade Marks Law governs how trademarks are registered in Cyprus and divide commodities and services into eight groups. The Trademarks Law, Chapter 268, and case law are present in Cyprus. Only authentic trademarks in Cyprus may be registered. Trademarks must be registered with the Trade Marks Registrar and only a Cyprus law firm may apply. - The WIPO (World Intellectual Property Organisation) Convention,
- The Madrid Protocol,
- The Agreement on Trade-Related Aspects of Intellectual Property Rights.
Trademark Registration Process
To register a trademark in Cyprus, we will need a power of attorney ( which can be general) and a filled application form called Form TM2. A separate application must be submitted for each class of goods or services.
The Cypriot Trademark Registrar will review the petition when it is submitted, and it will then be published for two months in the Official Gazette. Anyone with a good reason may file a trademark objection during these two months. The Cypriot Registrar will issue a registration certificate with a copy of the trademark if no opposition is filed.
In Cyprus, trademarks have a seven-year initial registration period of validity before they can be renewed for another seven years for a total of fourteen years.
The Registrar must examine the trademark after submitting the application to ensure that it conforms to all legal criteria. A Cypriot trademark must adhere to the following conditions to be registered:
- it must be distinctive,
- it must not resemble any previously registered trademark
- it must not deceive the public it is intended for
Based on these criteria, the Registrar may accept the trademark registration, accept the registration subject to specified conditions, request that the application be changed, or refuse to accept the registration. The Cypriot Supreme Court will hear appeals to the Registrar’s decision.
Period to Oppose
After a trademark application has been published in the Official Gazette for two (2) months, third parties may launch trademark opposition actions against the application. Depending on the specifics of each situation, many conditions will affect the odds of an opposition’s success.
Validity Period
The initial validity of a registered trademark in Cyprus is seven (7) years from the application date. It can then be extended for a further fourteen (14) years in a row. A trademark renewal request may be made within three (3) months after the expiration date.
