Trademark Registration in Estonia

Registering your trademark in Estonia is crucial because doing so grants you legal protection for the mark. The Estonian Patent Office permits registration in the Republic of Estonia (Patendiamet). It is important to remember that because Estonia is one of the 28 members of the European Union, European Union Trademarks (EUTM) cannot be altered there. Also, a party to the Madrid Protocol is Estonia. Legal documents of the European Union, particularly Directive (EU) 2015/2436 and Regulation (EU) 2017/1001, and Estonian trademark law control the registration of trademarks and logos in Estonia.

Trademark Registration Process

Within about a month of the filing being finished, the official notification of the application’s receipt is issued. After that, a substantive review of the Estonian trademark application lasts for around five months. The trademark is published in the Official Bulletin for a two-month opposition period if it satisfies the protectability standards. Assuming there is no opposition within about a month, the trademark is registered, and the certificate is issued. A provisional denial in trademark registration is issued if the substantive examination reveals any barriers to registration; this rejection may be appealed within an additional two months.

Period to Oppose

In Estonia, trademark applications are evaluated for formal requirements and registerability. In the Estonian Trade Mark Gazette, a notification announcing the issuance of the decision to register a trademark is published. As mentioned above, opposition to the trademark registration may be submitted within two months of publication of the notification.

Validity Period

There isn’t a set grant fee. The registration of a trademark is good for ten years after the date of filing and is perpetually renewable for additional ten-year periods. Ten years are counted from the date of registration for trademarks for which applications were submitted before April 1, 2019.

A renewal request must be submitted one year before the trademark’s protection expires. After the renewal deadline has passed, a trademark may be renewed within six months as long as the associated fee has been paid. A trademark expires after six months and cannot be reinstated.

Requirement of Use

An interested party may file cancellation action with the Board of Appeal on condition that the trademark has not been used for five consecutive years after registration.
