Trademark Registration in the Czech Republic

The application process includes a formal examination and an examination of distinctiveness but no search for prior trademarks. Before the trademark authority or registration issues an office action, it usually takes 6 to 8 months. The trademark is published in the weekly Official Journal of the Czech Industrial Property Office before registration. Three months after the trademark application’s publication, the opposition period begins.

The opposition period is three months from the publication of the trademark application.

Validity Period

A trademark certificate’s official fee must be paid within 30 days of the application’s filing. A registered trademark in the Czech Republic is protected for ten years from the application’s filing date. Protection may be extended an infinite number of times for additional 10-year terms. The renewal request may be submitted at the earliest during the final year of the protection’s duration but before the expiration date. A renewal request can also be submitted within six months of the expiration date, although there is a higher fee. The trademark expires if the renewal request is not submitted.

Requirement of Use

Cancellation based on non-use is possible in the Czech Republic. It may occur if the trademark is not continuously used for more than five years from trademark registration.
