In the European Union, a registrable design must not be identical to, or produce the same overall impression on an informed user as, a design already publicly disclosed anywhere in the world before the filing date. A search against the EUIPO database and other public sources is the clearest way to check this before you file.
Because EU design registration doesn't involve substantive novelty examination at filing, an unsearched application can register even if it isn't truly new — leaving it vulnerable to a later invalidity action if challenged.
