Brealant Limited · Effective date: 18 October 2026
These Terms of Service govern every service you buy from Brealant Limited ("Brealant", "we", "us"): trade mark, patent, design and copyright searches, applications, renewals and the related work. Our Terms of Use (for the Website and Hal, our AI) and our Privacy Policy also apply. By accepting a quote, paying, or instructing us to act, you agree to these terms.
Brealant Limited is an intellectual property services company incorporated in Hong Kong, China, registered office Unit 9D, 36 Hung To Road, Kwun Tong, Kowloon, Hong Kong. Brealant is not a law firm and does not give legal advice. We prepare and file applications and manage them with the government offices. We do not advise you on your legal rights, remedies or options and do not represent you in court. Where a country requires a registered local agent or attorney, Brealant engages one on your behalf as your filing representative before that office. No lawyer–client relationship arises between you and Brealant. If you want advice about your situation, consult a lawyer qualified in the relevant country.
Our review of the information you give us is limited to completeness, consistency and the formal requirements of the office. We do not review it for legal sufficiency, and we do not decide whether your mark, invention or design is registrable: that is the office's decision.
You are responsible for the accuracy, completeness and legality of everything you give us: the applicant's name, address and legal status, the owner of the right, the goods and services, the inventors, the drawings, the specimens, the priority claims. You confirm that you have the right to apply and, where you apply on behalf of someone else, that you have their authority and their consent to share their information with us.
A quote becomes an order when you accept it in writing (including by email) and pay. Prices are in the currency stated in the quote. Government fees are shown separately from our service fees; government fees are payable to the relevant office and may change without notice, and any increase between quote and filing is payable by you. We may ask for payment in full before we begin work. Invoices are payable on receipt. If we cannot start or complete the work because we are waiting for information or payment from you, the order may be treated as abandoned after our reminders, and the payments made remain non-refundable. Refunds are governed by the Brealant Guarantee, which forms part of these terms.
We never guarantee an outcome. Every decision to accept, refuse or register an application is made by the relevant government authority. Brealant is not that authority and cannot control its decision.
All payments to Brealant are non-refundable, except as set out in the Brealant Guarantee: for trade marks, designs and copyright, a refund of our service fee within 30 days of purchase or until we file, whichever comes first; patent and utility model work is non-refundable from the order.
You approve your filing. Before we file, we send you a pre-filing form for your approval. You are responsible for checking it and catching any error in it, whoever made the error.
Approval is not the end. Even after the government approves your application, it may still be opposed or cancelled, or become the subject of litigation in future.
Our chatbot. Hal is an AI; it never gives legal advice, only summaries and public information.
No one can change these terms. No Brealant employee, agent or chatbot can promise an outcome or change these terms, in writing or verbally. Any such statement does not bind Brealant.
Your agreement. Brealant is happy to help with every phase of the process. By using our services, our website or our chatbot, you agree to these terms.
These terms, our Terms of Use and our Privacy Policy are the whole agreement between you and Brealant. They can be amended only in writing, by an email sent from sales@brealant.com that expressly states that it amends these terms for your matter. Nothing else amends them: no verbal statement by anyone at Brealant or acting for Brealant, no message in chat, WhatsApp or any other channel, no statement by Hal, our AI, and no email from a member of our staff that appears to conflict with these terms. Where a staff email and these terms conflict, these terms prevail.
Unless the quote says otherwise, our fee covers the work described in the quote and nothing else. It does not include legal advice, legal opinions, responding to office objections, oppositions, cancellations, appeals, enforcement, litigation, licensing, customs recordal, renewals, translations beyond those stated, or any government fee not listed. We will quote separately for any further work.
Many steps in an application have fixed deadlines set by the government office that cannot be extended. We will tell you about deadlines that need your action. If you do not respond in time, the application may lapse, and we are not responsible for the consequences. We communicate by email and through the Website; you are responsible for keeping your email address current, for reading our messages and for telling us promptly of any change in your details.
All communication about your matter goes through Brealant. The local filing agents we engage receive the information needed for the filing but not your contact details, and they do not contact you directly. You agree not to contact them directly about work we are handling.
To the fullest extent the law allows, Brealant is not liable for any indirect, consequential or special loss, including lost profit, lost business or lost opportunity, arising from our services. Where liability cannot be excluded, our total liability for any matter is limited to the service fees you paid Brealant for that matter. Nothing in these terms excludes liability that cannot be excluded by law.
How we handle personal data, including the information on your application, is explained in our Privacy Policy, which forms part of these terms.
We may change these terms from time to time by publishing a new version on the Website. The effective date at the top shows when they were last changed. Work already ordered is governed by the terms in force when you ordered it.
These terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, and any dispute is subject to the exclusive jurisdiction of the courts of Hong Kong.
