This guarantee is part of our Terms of Service. It says what we promise, when a refund is possible, and when it is not. Where this guarantee and any other statement differ, this guarantee applies.
If Brealant made a mistake on your order, we will correct it at no cost to you. Tell us at sales@brealant.com as soon as you notice it. Correcting a mistake means re-doing the work or re-filing where the office allows it; it does not mean a refund, and it does not change the office's decision on your application.
For a trade mark, design or copyright application, you may ask for a refund of our service fee within 30 days of purchase or until we file, whichever comes first. Once we have submitted the application to the intellectual property office, we no longer issue a refund, even if that is within 30 days. If your order covers several applications or several countries, the whole order becomes non-refundable once any one of them has been submitted.
A refund covers our service fee only. It does not cover government fees we have already paid, or costs we have already paid to third parties for your matter (for example local filing agents, searches, translations or drawings). These are deducted from any refund.
Patent and utility model work is non-refundable from the moment you order it. We start drafting and preparing the application as soon as your order is accepted, and preparing a patent application takes time before it can be filed, so there is no refund window. The same applies to patent searches, drafting, drawings, translations and office responses.
Once an application or document has been submitted to the office, all payments are non-refundable, whatever the office then decides. We never guarantee an outcome: every decision to accept, refuse or register an application is made by the relevant government authority, and Brealant is not that authority.
For trade mark work that is not filed with an office, such as a search report or an opinion on registrability, you may ask for a refund within 30 days of purchase, as long as we have not yet delivered the work. Once it has been delivered to you, it is non-refundable. Patent reports and searches are non-refundable from the order, as above.
For legal services provided through our affiliated attorneys and local agents, refunds are not covered by this guarantee. Please refer to the agreement that you accept directly with their firm.
Write to sales@brealant.com from the email address on your order, quoting the order or invoice number. We confirm whether the order qualifies under this guarantee and, if it does, refund by the method you paid with, less any government fees and third-party costs already paid.
This guarantee does not change the rest of our Terms of Service: we never guarantee an outcome, you approve the pre-filing form and are responsible for errors in it, and no verbal statement, chat message, statement by Hal, our AI, or staff email amends this guarantee. It can be varied for you only by an email sent from sales@brealant.com that expressly says so.
